US DOT's Proposal on Oversales and Denied Boarding Compensation

On 10 July 2007, the US Department of Transportation published an “Advance Notice of Proposed Rulemaking (ANPRM)” seeking comment on several issues associated with the oversales and DBC rule.

In its September response, AAPA acknowledged that adjustments on the denied boarding compensation limits would be appropriate but any adjustments should be based on industry yield. AAPA also objected to automatic adjustments, stating its preference for periodic reviews when necessary.

In addition, AAPA commented that the seating capacity exception rule should only exclude aircrafts with less than 30 seats, and supported the proposed relaxation of reporting requirements.

The US DOT issued a Notice of Proposed Rulemaking (NPRM) in November 2007, which proposes to double the limits on compensation from US$200 to US$400 for passengers who are rerouted within two hours (four hours internationally) and from US$400 to US$800 for passengers who are not rerouted within these times.  The industry's comments were taken onboard by the US DOT for the other proposals.

AAPA did not submit additional comments in response to the NPRM, as members’ feedback contained similar views as the ANPRM.
